Account means a unique account created for You to access our Service or parts of our Service.

Application/ Platform means the software program provided by the Company downloaded by You on any electronic device, named “SmartBenefits app”.

Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Smart PFM Private Limited, having its Office at 3rd Floor, 104-C, DHA Phase 2 Extension, Karachi. 

Cookies are small files that are placed on Your computer, mobile device smartphone, tablet/ phablet or any other device by a website, containing the details of Your browsing history on that website among its many uses; the cookies help the application / website to save and remember any preferences that may have been set while the User was browsing the website.

Country refers to: Pakistan

Device means any device that can access the Service such as a computer, a cell phone, a digital tablet workstation, terminal, handheld PC, personal digital assistant or any other hardware where software can be installed that would allow End User to access the services as provided by the Company.

Personal Data means any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with Us or identifiable individual, is capable of identifying such person including, but not limited to:

1 – password;
2 – financial information such as Bank account or credit card or debit card or other payment instrument details;
3 – physical, physiological and mental health condition;
4 – sexual orientation;
5 – medical records and history;
6 – biometric information;
7- any detail relating to the above clauses as provided to Us for providing service; and
8 – any of the information received by Us for processing or storage under lawful contract or otherwise:

Provided that, any information that is freely available or accessible in public domain or furnished under any law for the time being in force shall not be regarded as personal information for the purposes of this policy.

Service refers to the Application or the Website or both.

Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analysing how the Service is used.

Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.

Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

Website refers to Smart Benefits website, accessible from https://smartbenefits.pk

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. 

Privacy Policy refers to this Privacy Policy, and any subsequent amendments hereto.

Account creation date (joining date)

Usage Data is collected automatically when using the Service.

date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

Similarly, other users will be able to view descriptions of Your activity, communicate with You and view Your profile.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Rights to Access, or Delete Your Information

Users can access individual profile information by logging in to your SmartBenefits employee app

Users can reach out to admin@smartbenefits.pk for data deletion request, however this shall be subject to applicable laws & regulations and the Company’s data retention policy, as may be amended from time to time.

Disclaimer of liability

We shall not be responsible in any manner for the authenticity of the Information supplied by the User to Us or Our Affiliates or Third Party Service Providers, as the case may be. If a User provides any Information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or We have reasonable grounds to suspect that such Information is untrue, inaccurate, not current or incomplete, We have the right to suspend or terminate such User’s account at Our sole discretion.

We cannot ensure that all of Your Information including Personal Information will never be disclosed in ways not otherwise described in this Privacy Policy. As a User of the Sites, You assume all responsibility and risk for Your use of the Sites, the internet generally, and the information You post or access and for Your conduct on and off the Sites.

Data Protection Officer (Grievance Officer)

Any questions, discrepancies, and grievances of the provider of information with respect to processing of Personal Data may be made to the Company’s Data Protection Officer (Grievance Officer). The Grievance Officer shall redress the grievances of the provider of information expeditiously and in any event within a period of one month from the receipt of grievances.

In case of any queries regarding the content, interpretation, implications of this Policy, the provider of information may contact the Grievance Officer. Notwithstanding the above, We reserve the right to decline to process any such request which may jeopardize the security and confidentiality of the Personal Data of others, as well as requests which are impractical or not made in good faith, or the circumstances as provided for under the law permitting the Company to refuse such request(s).

Governing Laws

This Privacy Policy shall be governed by and interpreted and construed in accordance with the Laws of Pakistan. The place of jurisdiction shall be exclusively with the courts at Karachi, Pakistan

We have no control over and We assume no responsibility for the content, privacy policies or practices of any third party sites or services and the Use of, or reliance on any such links and the content thereon provided shall be at your sole risk.
